Rental Agreement
Terms & Conditions

This Rental Agreement (“Agreement”) is entered into between KC Mobility Scooter Rentals LLC (“Provider”) and the person signing the agreement (“Renter”) for use of agreed-upon rental equipment. KC Mobility Scooter Rentals LLC provides Mobility Scooters, Wheelchairs, Transport Chairs, Knee Scooters, Rollators, and other mobility device accessories (further known as “Equipment”) subject to all the terms and conditions set forth in this Agreement.The Renter agrees to the following:

1. Eligibility:
1.1 To rent Equipment, the Renter must be at least 18 years old or be the legal guardian responsible for a person under 18 years old.
1.2 The Renter must provide accurate and complete information during the rental reservation process, including height and weight. A copy of the drivers license or valid state-issued identification with a picture will be used to verify identity.
1.3 KC Mobility Scooter Rentals LLC reserves the right to refuse service to anyone for any reason at any time.

2. Rental Process:
2.1 All rental reservations are subject to availability.
2.2 The rental period begins on the date specified in the reservation and ends on the agreed pickup date, time, and location.
2.3 Late returns may incur additional fees of $50 per day or fraction thereof.
2.4 The Renter is responsible for the proper use and care of the rented Equipment during the rental period.
2.5 If the Equipment malfunctions (e.g., battery failure), a replacement battery or Equipment may be provided at the sole discretion of the Provider, who may also offer repair or refund.
2.6 The Equipment is provided on an “as is” and “as available” basis. No representations or warranties, express or implied, are made regarding performance or condition. An inspection will be conducted at delivery and pickup to ensure the Equipment is operational.

3. Use of Mobility Device:
3.1 The Renter agrees to use the Equipment in a safe and responsible manner, complying with all applicable laws, regulations, and local policies.
3.2 Only the Renter or authorized persons over 18 years old may operate the Equipment. No tandem riders are permitted.
3.3 The Renter will not use the Equipment for illegal activities or while using a phone for calls or texting.
3.4 The Renter will exercise caution while operating the Equipment, including but not limited to crossing traffic, navigating curbs, turning, maneuvering around obstacles, entering/exiting doors and maintaining a safe speed.
3.5 The Renter will not operate the Equipment under the influence of alcohol, recreational drugs, or medications that advise against operating equipment.
3.6 The Renter will not smoke while operating or near the Equipment.
3.7 The Renter will not remove, alter, or destroy any GPS tracker device attached to the rental equipment. All equipment with GPS trackers will have a sticker stating a GPS device is present.

4. Liability and Limitations:
4.1 The Renter assumes full responsibility for the safe and proper use of the Equipment during the rental period.
4.2 The Renter agrees to hold the Provider harmless from any liability, claims, damages, or expenses arising from the use or operation of the Equipment, including loss or damage to personal property left, stored, or transported with the Equipment.
4.3 The Provider shall not be liable for any injury, loss, or damage suffered by the Renter or any third party during the rental period, provided such loss or damage was not caused by the Providers gross negligence or willful misconduct.

5. Maintenance and Repairs:
5.1 The Provider will ensure the Equipment is in good working condition before the rental period begins.
5.2 The Renter must notify the Provider immediately of any mechanical issues for assistance and instructions.
5.3 The Renter is prohibited from making repairs or alterations to the Equipment beyond adjustments to the seat, armrest, or tiller positions.
5.4 Assistance and maintenance are available from 8:00 AM to 8:00 PM and limited to a 50-mile radius from 703 Pennsylvania Ave, Leavenworth, KS 66048. The Renter must return the Equipment within this radius for assistance.

6. Loss or Damage:
6.1 The Renter is responsible for any loss, theft, damage, or destruction of the Equipment during the rental period and must notify the Provider within two hours of any extreme or unnatural accidents.
6.2 The Renter will be liable for repair or replacement costs, as determined by the Provider, not to exceed the replacement cost of the Equipment. Non-defective Equipment exchanges incur a $25 fee.
6.3 If the Equipment is stolen, the Renter must file a police report, provide a copy to the Provider, and comply with legal requirements, including court appearances if applicable.

7. Governing Law:
7.1 This Agreement shall be governed by the laws of Leavenworth County, Kansas, without regard to conflict of laws principles.
7.2 Any disputes shall be subject to the exclusive jurisdiction of the county, state, and/or federal courts located in Kansas.

8. Termination:
8.1 Either party may terminate this Agreement with written notice if the other party fails to comply with any terms and conditions herein.

10. Rental Details:
10.1 The Provider agrees to provide the following mobility device(s) to the Renter: _________________

10.3 Damages (If applicable) Costs determined upon inspection during pickup of mobility device at conclusion of rental period. This payment shall be required upon determination of value. We recommend all renters to conduct a pre-inspection and take photos of any noticeable damage immediately upon retrieval of mobility equipment and to text them to (913) 775-1098. Pictures of damage received the day after the rental period begins will not be accepted.
10.4. Payment is accepted via major credit cards (MasterCard, Visa, Discover, American Express). Prepaid debit or gift cards, checks, or money orders are not accepted. By providing payment information, the Renter authorizes charges for applicable fees.
10.5 All payments are processed via Stripe.com. The Provider does not store credit card information.

11. Delivery and Pickup Appointments
11.1 Delivery and pickup times are requests and may be adjusted by the Provider up to 72 hours prior, with confirmation sent to the Renter. The Renter must confirm and adhere to these times or reschedule based on availability.
11.2 If Equipment is left or abandoned at a location (e.g., resort) without authorization from the resorts Bell Services or Resort Manager, a $75 fee will be charged, due immediately.

12. Cancellation and No-Show Policy
12.1 The Renter may cancel outside of 72 hoursl prior to the scheduled delivery day for a 100% refund to the original payment method or a future rental credit with no expiration. Refunds are issued only to the original credit card.
12.2 For missed delivery or pickup appointments without communication, a reschedule is required based on availability. If contact cannot be made, the appointment may be canceled.

13. Rental Extensions and Equipment Return
13.1 Equipment must be returned at the specified date/time. Extensions must be requested prior to expiration, subject to Provider approval and a $50 daily fee for unapproved extensions.
13.2 The Renter is responsible for replacement costs of lost parts or accessories, including but not limited to baskets, or chargers.

14. Battery, Key, and Manual
14.1 Equipment is fully charged at delivery. The Renter must charge the battery nightly inside a hotel room or rental property for at least 60 minutes but not exceeding 24 hours to avoid battery damage. (5-8 Hours a night is recommended)
14.2 A $20 fee applies for lost keys.
14.3 A digital copy of equipment user manual is available upon request. Once requested a PDF file for the equipment will be sent to requested email.

15. Entire Agreement
This Agreement constitutes the entire agreement between the Provider and the Renter, superseding any prior agreements or understandings, whether written or verbal.
